Terms and Conditions

These terms govern your use of the xskit.dev website and the @access-kit/react npm package (collectively, "AccessKit"). By using AccessKit, you agree to these terms. If you do not agree, do not use our services.

The npm package

The @access-kit/react package is distributed under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the package, subject to the conditions of the MIT License included with it.

The website

The xskit.dev website, including its design, code, blog content, documentation, and visual assets, is proprietary and all rights are reserved. You may browse the site and use it for its intended purpose (reading documentation, making contributions, etc.), but you may not copy, reproduce, distribute, or create derivative works from the website or its content without prior written permission.

Supporter contributions

AccessKit is and will remain entirely free. The Pricing page offers voluntary supporter contributions (one-time or recurring) processed by Stripe. These are not purchases. No features, priority support, or exclusive content are provided in exchange for a contribution.

  • Contributions are non-refundable unless required by applicable law.
  • Recurring contributions can be cancelled at any time through Stripe's customer portal. Links are available in the Pricing page
  • We reserve the right to remove the supporter contributions feature at any time.

No guarantee of accessibility compliance

AccessKit is a developer tool designed to assist in identifying and addressing accessibility issues. It does not guarantee, and should not be relied upon as a guarantee of, full or partial compliance with the Web Content Accessibility Guidelines (WCAG), Section 508 of the Rehabilitation Act, the European Accessibility Act, EN 301 549, the Americans with Disabilities Act (ADA), or any other accessibility standard, regulation, or law, whether current or future.

Automated and semi-automated auditing tools are inherently limited. They cannot detect all accessibility barriers, cannot evaluate subjective user experience, and cannot substitute for manual testing, assistive technology testing, or expert review. Audit results produced by AccessKit should be treated as informational guidance, not as a certification or attestation of compliance.

It is every developer's and organization's sole responsibility to understand the accessibility standards and legal requirements applicable to their projects, to implement those requirements independently, and to verify compliance through their own testing and review processes. The use of AccessKit does not transfer, reduce, or satisfy any such responsibility.

You acknowledge and agree that AccessKit is one tool among many that may assist you in improving accessibility, and that no tool, including AccessKit, can replace informed human judgment and diligent implementation of accessibility practices.

Intellectual property

The AccessKit name, logo, and website design are owned by us. Blog posts and documentation content are our original work and may not be republished in full without permission. The @access-kit/react npm package is licensed separately under MIT.

User conduct

You agree not to:

  • Use the website or services to engage in any unlawful activity.
  • Attempt to interfere with or disrupt the website's infrastructure.
  • Scrape, crawl, or automatically collect data from the website beyond what is publicly available through normal browsing or the npm registry.
  • Misrepresent your affiliation with AccessKit.

Third-party services

Your use of those services is subject to their respective terms. We are not responsible for the availability or conduct of third-party services.

Disclaimer of warranties

AccessKit is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness. We make no warranty or representation that:

  • the tools will be error-free, uninterrupted, or free of defects;
  • audit results, suggestions, or fixes will be complete, accurate, or up to date;
  • use of AccessKit will result in compliance with any accessibility standard, regulation, or law; or
  • any particular accessibility barrier will be detected or resolved by the tools.

No information or advice provided by AccessKit, whether through the software, the website, documentation, or any other channel, constitutes a warranty or guarantee of accessibility compliance.


Limitation of liability

To the fullest extent permitted by applicable law, AccessKit and its maintainers, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the software, website, or any related services, regardless of the theory of liability (including contract, tort, negligence, strict liability, or otherwise), even if advised of the possibility of such damages.

Without limiting the foregoing, AccessKit shall bear no liability whatsoever for any claim, loss, damage, fine, penalty, legal action, or regulatory proceeding arising from or related to the failure of any application, website, or digital product to meet accessibility standards, regulations, or legal requirements, regardless of whether AccessKit was used in the development, testing, or auditing of that application, website, or digital product. This includes, but is not limited to, claims brought under the ADA, WCAG, Section 508, EN 301 549, the European Accessibility Act, or any equivalent law in any jurisdiction.

You agree that AccessKit is not a substitute for professional accessibility consulting, legal advice, or manual compliance testing, and that any reliance on AccessKit's output for compliance purposes is at your sole risk.

Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of AccessKit after changes constitutes acceptance of the updated terms.
